On Sept. 12, 2017, the Ohio Supreme Court heard oral arguments in a case that will determine when the statute of limitations begins to run on the agent’s liability — at the time the policy is issued or when the problem with the policy is discovered (which is known as the delayed damages rule).In the case before the Court, LGR Realty purchased commercial insurance coverage from Frank & London Insurance Agency for the period of May 12, 2010 through May 12, 2011. When a third party claim occurred during the period of the policy, their insurance carrier denied coverage on April 26, 2011. Consequently, LGR Realty spent over $420,000 in legal fees to defend the action. LGR Realty sued Frank & London Insurance Agency for negligently obtaining unsatisfactory insurance on April 17, 2015.The trial court decided in favor of the insurance company, citing the four-year statute of limitations that began to run when the policy was issued. This meant that the complaint was time barred, as the four-year statute had run before the lawsuit was filed.On appeal, the Tenth District Court overturned that decision and held that the statute of limitations was four years but did not start to run until the tortuous act was discovered, when the insurance policy failed to cover the insured.And now we wait for a decision from the Ohio Supreme Court.In case you are sitting there rolling your eyes at this legal drama, keep in mind this might well have been a farmer who called his insurance agent after he purchased a chopper and asked the agent to include it in the farm policy and add any necessary riders for appropriate coverage. Then, five years later, the chopper is severely damaged when a rock is sucked in with the corn the farmer is chopping. The repair bill is in excess of $12,000. The dealership who sold the chopper repairs the chopper and suggests the farmer submit the bill to his insurance agent since the act should be covered. Imagine the drama when the farmer learns that the agent never suggested or added an ingestion rider to the policy. If the statute begins to run when the chopper was added to the policy, the farmer cannot pursue legal action against the agent. If the statute begins to run, however, when the farmer learned that the ingestion rider was never offered to him, then the farmer can sue the agent for damages, if he elects to. And I can think of numerous other examples that would make agriculture watch closely for this decision.I am not advocating that we run around threatening our insurance agents with lawsuits. It is a good idea, however, to insist they visit your farm every year so they have a thorough understanding of the operation they are providing coverage. Also, make certain to notify your agent every time you add or remove any equipment from your operation. With insurance, there is beauty (and coverage) in the details.All of the liability and contracts in the world cannot make folks work together. Lucas was born just over 30 years ago in Toowoomba, Queensland, and was living in the United Kingdom. He was the driving force behind the development of referees throughout the United Kingdom and Europe. Lucas was a great contributor to the sport in Scotland and Europe and had been named as an associate member of the FIT referee panel for the period post the 2011 World Cup up to and including the 2015 World Cup. Last July, Lucas was named the Male Referee of the Tournament at the 2010 European Championships. Lucas was a person that always strived for his personal best at all times, and at the same time, ensured that he worked for his mates to bring them with him. December has not been kind to the Columbus Blue Jackets. “December is the big month in the NHL schedule for everybody,” Jackets coach Scott Arniel said. “This is an important month. Not off to a very good start.” The Blue Jackets have lost five consecutive games, including all three games in December. Last December, the Blue Jackets went 2-9-5. “I don’t care what happened last season,” Blue Jackets defenseman Mike Commodore said. “Honestly, I don’t give a s—. It’s a new season, we’ve lost a couple games in a row — big deal.” Forward R.J. Umberger said he thinks the team is frustrated but not dead. “I think any team would be a little frustrated when you lose five in a row, when you lose a couple big games,” Umberger said. “How do you respond to it? We still control our own destiny — it’s December.” Commodore and Umberger’s frustrations came after Saturday’s 7-2 home loss to the Pittsburgh Penguins, which was preceded by a 5-0 loss against the Buffalo Sabres on Friday in Buffalo. Arniel managed to find some positives in the game against the Penguins. The team has allowed six goals while on the penalty kill in the last two games. Commodore could not explain the weekend’s penalty-killing woes. “Every once in a while, the pucks are going to go in,” Commodore said. “That’s just how it is, and they’ve gone in the last two nights.” Commodore said he thinks the team might be mentally fragile amid the string of losses, but it is not an excuse to keep losing. “There’s no point in sitting around and sulking about it,” he said. “We have to keep working, and I think we’ll come together.” Arniel said he and the staff need to work with the players to get their minds set on winning. “It’s part of what coaching is,” Arniel said. “I have to try to change the psyche of players and (not) think that just because they gave up a goal the game’s over, or if you lose a game, it’s the end of the year.” Arniel said the losing streak stems from poor play in many facets of the game. “The power play obviously at home (has) been a big one,” Arniel said. “We were one of the best goals-against teams in the league. When you’re losing, you can nitpick like crazy.” But Arniel said he wants to put the poor play behind him and focus on the Dallas Stars, who play in Columbus tonight. “I just want to win Monday night. That’s all I care about,” Arniel said. “I don’t care what’s already happened. I care about Monday night.”
